Article 7:753 Dutch Civil Code, Book 7

Artikel 753 Burgerlijk Wetboek Boek 7 (BW) – unofficial English translation

Boek 7 · Division 1. Contract for work in general

Paragraph 1

If, after the contract has been concluded, cost-increasing circumstances arise or come to light without this being attributable to the contractor, the court may, on a claim by the contractor, adjust the agreed price wholly or partly to the cost increase, provided that the contractor did not need to take into account the possibility of such circumstances when determining the price.

Paragraph 2

The contractor may adjust the price without the intervention of the court if the cost increase is the result of incorrect information provided by the client which is relevant to determining the price, unless the contractor ought to have discovered the inaccuracy of the information before the price was fixed.

Paragraph 3

The provisions of paragraphs 1 and 2 apply only if the contractor has warned the client as soon as possible of the need for a price increase, so that the client can in good time either exercise the right granted to the client in Article 764 or make a proposal to limit or simplify the work.
