Artikel 417 Burgerlijk Wetboek Boek 7 (BW) – unofficial English translation

Boek 7 · Division 2. Mandate

Paragraph 1

An agent may also act as agent of the counterparty only if the content of the juridical act is so precisely determined that a conflict between the interests of both principals is excluded.

Paragraph 2

If the principal is a person as referred to in Article 408(3), his or her written consent is required for the permissibility of a juridical act in which the agent also acts as agent of the counterparty.

Paragraph 3

An agent is not entitled to remuneration from a principal in respect of whom it acts contrary to the provisions of the previous paragraphs, without prejudice to its obligation to compensate the damage suffered by that principal as a result. No derogation may be made from this provision to the detriment of a principal.

Paragraph 4

If one of the principals is a person as referred to in Article 408(3), and the juridical act is aimed at the purchase or sale, or the renting or letting, of an immovable thing or part thereof or of a right to which the thing is subject, the agent is not entitled to remuneration from the buyer or tenant. No derogation may be made from this provision to the detriment of the buyer or tenant, regardless of whether the seller or landlord owes remuneration in respect of the mandate given by it.
