Artikel 941 Burgerlijk Wetboek Boek 7 (BW) – unofficial English translation

Boek 7 · Division 1. General provisions

Paragraph 1

As soon as the policyholder or the person entitled to the benefit knows or ought to know of the materialisation of the risk, that person is obliged to notify the insurer of the materialisation. This is done as soon as reasonably possible.

Paragraph 2

The policyholder and the person entitled to the benefit are obliged to provide the insurer, within a reasonable period, with all information and documents which are relevant to the insurer for assessing its obligation to pay the benefit.

Paragraph 3

If the person entitled to the benefit has failed to comply with an obligation as referred to in paragraph 1 or 2, the insurer may reduce the benefit by the damage it suffers as a result.

Paragraph 4

The insurer may stipulate forfeiture of the right to the benefit for failure to comply with an obligation as referred to in paragraphs 1 and 2 only for the event that its reasonable interests have been prejudiced as a result.

Paragraph 5

The right to the benefit is forfeited if the policyholder or the person entitled to the benefit has failed to comply with an obligation as referred to in paragraphs 1 and 2 with intent to mislead the insurer, save in so far as that deception does not justify the forfeiture of the right to the benefit.
